5.505 — INCITING IN A RIOT
Violations of "Statute 5.505" results in a Class D Misdemeanor
(a) Definitions
Inciting in a riot refers to the act of intentionally encouraging, provoking, or urging others to engage in unlawful and violent conduct during a riot or public disturbance. This includes speeches, written material, or any actions that incite others to participate in violent behavior, destruction of property, or threats to public safety.
(b) Elements
To establish the offense of inciting in a riot, the prosecution must prove beyond a reasonable doubt the following elements:
The defendant knowingly and intentionally encouraged or provoked others to engage in unlawful, violent, or destructive behavior during a public disturbance.
The defendant’s actions, words, or conduct directly led to the escalation of a riot, influencing others to participate in or contribute to the unlawful assembly.
The defendant’s actions took place during a situation where three or more individuals were engaged in a public disturbance that was escalating into a riot.
(c) Defenses
Defenses against a charge of inciting in a riot may include:
