PREAMBLE
PREAMBLE WHEREAS, the City of Los Santos recognizes the need to distinguish active law enforcement vehicles from privately owned or decommissioned ones to ensure public trust, prevent impersonation, and maintain public safety;
WHEREAS, the Mayor of Los Santos, with advisement from the Chief of Police and legal counsel, seeks to regulate the use, sale, and appearance of retired law enforcement vehicles within city limits;
WHEREAS, certain features and equipment associated with active law enforcement may cause confusion or misuse if retained on decommissioned vehicles;
NOW, THEREFORE, BE IT ORDAINED by the Mayor of Los Santos as follows:
Section 1: Purpose and Intent
This ordinance regulates the private ownership and public operation of decommissioned law enforcement vehicles ("retired LEO vehicles") to:
Prevent impersonation of law enforcement personnel.
Minimize public confusion caused by police-style vehicles.
Reinforce clear and lawful distinctions between official and civilian vehicles.
Ensure proper oversight of retired LEO vehicles resold or used within city limits.
Section 2: Definitions
"Retired Law Enforcement Vehicle" refers to any motor vehicle previously operated by a municipal, county, or state police agency—including but not limited to the Los Santos Police Department (LSPD), Los Santos County Sheriff's Office (LSCSO), Blaine County Sheriff's Office (BCSO), and San Andreas State Troopers (SAST)—which has been sold, transferred, or otherwise removed from official law enforcement service.
"Police Equipment" includes but is not limited to sirens, lightbars, external push bumpers, prisoner transport restraints, PA systems, and active emergency lighting systems
Section 3: Regulations on Retired Law Enforcement vehicles
3.1 Prohibited Features on Privately-Owned Retired LEO Vehicles The following are strictly prohibited on all retired LEO vehicles operated within the City of Los Santos:
a. Active or non-disabled emergency lighting systems (including flashing blue, red, or white lights).
b. Lightbars of any kind mounted on the roof or externally.
c. Sirens, PA systems, or any form of active emergency communication equipment.
d. Police-specific decals, emblems, department names, or impersonating markings.
e. Any official police insignia, state seals, or logos resembling LSPD, SAHP, SAST, BCSO, LSCSO, or similar agencies.
3.2 Permitted Features The following features are permitted on privately-owned retired LEO vehicles, provided they comply with subsection 3.3:
a. Side-mounted spotlights.
b. Rear passenger transport cages.
c. Internal light mounts (excluding lightbars) that are permanently disabled or disconnected from any power source.
d. Black-and-white or solid-color paint schemes, unless combined with markings or external lights that violate 3.1.
3.3 Mandatory Deactivation All permitted emergency equipment must be:
a. Permanently disconnected from any power supply;
b. Verified as inoperable during any routine inspection or traffic stop by LSPD;
c. Documented upon registration with the San Andreas Department of Motor Vehicles (SADMV).
Section 4: Enforcement and Penalties
4.1 Violation Consequences Any individual found operating a retired LEO vehicle in violation of Section 3 may be subject to:
a. First offense: Citation and fine up to $1,500; vehicle may be temporarily impounded.
b. Second offense: Fine up to $3,000 and mandatory vehicle impound.
c. Third offense or repeat violation: Permanent vehicle seizure and possible misdemeanor charges for impersonation.
4.2 Immediate Confiscation Clause Any retired law enforcement vehicle purchased or transferred within the City of Los Santos that does not comply with this ordinance may be:
a. Returned to the Los Santos Police Department for reassessment;
b. Confiscated and reabsorbed into the respective department's fleet or auctioned in compliance with city resale laws.
4.3 Reporting Residents may report improperly equipped vehicles to the Los Santos Police Department using the Los Santos Police Department hotline or through the Mayor's Office directly via [email protected]
Section 5: Sales and transfers within City Limits
a. Any retired LEO vehicle purchased within city limits—regardless of originating agency (LSPD, LSCSO, BCSO, SAST, etc.)—must be reported to the San Andreas DMV within 10 business days.
b. Such vehicles are subject to mandatory inspection by LSPD before legal operation on public roads.
c. Dealerships or private sellers must disclose the prior law enforcement use and confirm all prohibited equipment has been removed or deactivated.
d. Failure to report or comply will result in vehicle forfeiture.
Section 6: Implementation and Public Awareness
a. The San Andreas DMV and Police Department shall jointly distribute information regarding this ordinance to all auto dealers, private vehicle sellers, and vehicle registration offices.
b. Signage and digital outreach will be used to inform the public and discourage unlawful modification of retired police vehicles.
Section 7: Funding Allocation
All proceeds from the sale, transfer, or auction of any retired law enforcement vehicle within the City of Los Santos shall be allocated directly to the respective law enforcement department where the vehicle came from. These funds shall be used to support training programs, equipment upgrades, and community policing initiatives. No portion of such proceeds may be diverted for general city use or other departmental funding.
BE IT FURTHER RESOLVED, that this ordinance shall take effect on MAY 19TH, 2025 and remain in full force and effect until amended or repealed by the Mayor of Los Santos
