5.507 — PROSTITUTION
Violations of "Statute 5.507" results in a Class B Misdemeanor
(a) Definitions
Prostitution refers to the act of engaging in or offering to engage in sexual acts or services in exchange for money, goods, or other forms of compensation. This includes soliciting or agreeing to engage in such activities, as well as knowingly participating in or promoting prostitution, whether or not the act is completed. Prostitution also encompasses both the offer and acceptance of sexual services for compensation, and it may occur in public or private settings.
(b) Elements
To establish the offense of prostitution, the prosecution must prove beyond a reasonable doubt the following elements:
The defendant knowingly engaged in or offered to engage in sexual acts or services.
The defendant engaged in or offered these services in exchange for money, goods, or other forms of compensation.
The defendant knew that the interaction involved prostitution, and that sexual services were being offered in exchange for compensation.
The defendant participated in the act of prostitution within the jurisdiction where it is prohibited under San Andreas law.
(c) Defenses
Defenses against a charge of prostitution may include:
The defendant did not engage in sexual acts or offer sexual services for compensation, and the interaction was misinterpreted.
The defendant was unaware that the exchange involved prostitution or was initiated by another person.
The defendant did not intend to offer or engage in prostitution and was mistaken about the nature of the transaction.
The defendant claims that they were coerced or forced into engaging in prostitution and did not do so voluntarily.
(d) Aggravating Factors
The court may consider the following aggravating factors when determining the severity of the offense:
The defendant has a history of engaging in prostitution or soliciting others for prostitution.
The defendant was involved in organizing or promoting a prostitution operation, including managing or facilitating others in prostitution.
The defendant engaged in prostitution involving a minor or coerced another individual into prostitution.
The prostitution occurred in a public area or near a location where it posed a threat to public safety, such as near schools or government buildings.
