7.730 — IMPEDING TRAFFIC

Violations of "Statute 7.730" results in an Infraction and a fine of $250

(a) Definitions

Impeding traffic refers to any action or behavior by a driver, pedestrian, or other individual that obstructs or slows the normal flow of traffic on a roadway, making it more difficult or unsafe for others to move through or around the area.

(b) Elements

To establish the offense of impeding traffic, the prosecution must prove beyond a reasonable doubt the following elements:

  • The defendant engaged in conduct that hindered the smooth flow of traffic, such as driving too slowly, stopping unnecessarily, or blocking lanes.

  • The defendant's actions caused or had the potential to cause delays or disruptions to the movement of other vehicles or pedestrians.

  • The defendant’s conduct occurred on a public roadway, and it was unreasonable under the circumstances.

(c) Defenses

Defenses against a charge of impeding traffic may include:

  • The defendant was lawfully stopped or moving slowly due to an emergency situation or to ensure safety.

  • The defendant’s actions did not significantly affect the flow of traffic or cause a noticeable disruption.

  • The defendant was legally allowed to stop or slow down for a specific purpose, such as yielding to pedestrians or obeying a traffic signal.

(d) Aggravating Factors

The court may consider the following aggravating factors when determining the severity of the offense:

  • The defendant’s actions led to significant traffic congestion, accidents, or danger to other drivers.

  • The defendant impeded traffic in a high-risk area, such as near school zones, construction zones, or busy intersections.

  • The defendant repeatedly impeded traffic or displayed a pattern of reckless or inconsiderate driving behavior.
