CITY ORDINANCE NO. 2025-003
This Los Santos City Ordinance No. 2025-003 pertains to regulating prohibiting smoking in government-associated buildings and establishments that do not permit it.

PREAMBLE
PREAMBLE WHEREAS, the City of Los Santos is committed to promoting public health, safety, and welfare; and
WHEREAS, exposure to secondhand smoke has been proven to cause adverse health effects to non-smokers; and
WHEREAS, it is necessary to regulate smoking in public spaces and government-associated properties to ensure a safe and clean environment for all residents, employees, and visitors.
NOW, THEREFORE, BE IT ORDAINED by the Mayor of Los Santos as follows:
Section 1: Purpose and Intent
This ordinance is enacted to protect the public from involuntary exposure to secondhand smoke and to promote healthy, smoke-free environments, particularly in spaces used for governmental operations and public services.
Section 2: Definitions
"Smoking" means inhaling, exhaling, burning, or carrying any lighted or heated cigar, cigarette, pipe, vape, hookah, or any other tobacco, cannabis, or nicotine-related product.
"Government-Associated Building" refers to any structure or facility owned, leased, or operated by the City of Los Santos or any state agency operating within city limits, including but not limited to:
The Los Santos Capitol Building/City Hall
Los Santos Police Department precincts
Los Santos Courthouses
Los Santos Public transportation hubs and terminals
Los Santos Public libraries
Los Santos Government health and welfare buildings
Airports within Los Santos jurisdiction
Gas stations within Los Santos jurisdiction
The Los Santos Vespucci Beach
The Los Santos Mirror Park Lake and Park
The Los Santos Cemetery
Little Seoul Park
Section 3: Prohibited Smoking Areas
It is unlawful to smoke in any of the following areas within the City of Los Santos:
Government-Associated Buildings as defined above, including within 25 feet of any entrance, exit, operable window, or ventilation intake of such buildings.
Indoor places of employment, including but not limited to:
Offices
Conference rooms
Break rooms
Elevators
Stairwells
Restrooms
Any business or establishment that has clearly posted “No Smoking” signage, regardless of ownership or function.
Public recreational and environmental areas, including:
Parks, playgrounds, and green spaces where smoking is not expressly permitted
Outdoor sports facilities and athletic fields that do not permit smoking
City-maintained beaches and boardwalks, including Vespucci Beach
The Mirror Park Lake and Park area
The Los Santos Cemetery grounds
Little Seoul Park
Any public areas or public transit waiting areas (such as shelters or terminals)
Public transportation systems, including:
City buses, light rail, or train cars
Public transit stations or platforms
City-owned service vehicles or transport shuttles
Section 4: Designated Smoking Areas
Smoking may be permitted in outdoor areas designated by property management, so long as they are:
At least 35 feet away from building entrances and exits;
Within the designated "Smoking Zones";
Properly marked and equipped with waste disposal receptacles.
Section 5: Exceptions
This ordinance does not apply to:
Private residences that are not open to the public.
Licensed tobacco or cannabis lounges operating in accordance with city zoning laws and health codes.
Film or theatrical productions where smoking is part of the scripted performance.
Section 6: Enforcement and Penalties
First Offense: Written warning and a fine of up to $250.
Second Offense: Fine of up to $500.
Third and Subsequent Offenses: Fines up to $1,000 and potential misdemeanor citation.
Business owners who fail to post appropriate signage or enforce the no-smoking rule may face:
Fines up to $2,000
Temporary suspension of business license for repeated offenses.
Section 7: Public Awareness
The City of Los Santos shall:
Distribute signage and educational materials to government and private buildings;
Launch a citywide campaign to inform residents and business owners of the ordinance;
Offer cessation resources for individuals seeking help to quit smoking.
BE IT FURTHER RESOLVED, that this ordinance shall take effect on MAY 27TH, 2025 and remain in full force and effect until amended or repealed by the Mayor of Los Santos
