6.603 — PROVIDING MATERIAL SUPPORT FOR TERRORISM
Violations of "Statute 6.603" results in a Class A Felony
(a) Definitions
Providing material support for terrorism is defined as knowingly providing resources, funds, goods, services, or training to individuals, organizations, or groups engaged in or planning acts of terrorism. This support is intended to aid, facilitate, or further terrorism-related activities that involve violent acts or the threat of violence to achieve political, ideological, or religious goals.
(b) Elements
To establish the offense of providing material support for terrorism, the prosecution must prove beyond a reasonable doubt the following elements:
The defendant knowingly provided material support, such as money, equipment, training, or other resources, to individuals or organizations engaged in terrorism or terrorist activities.
The material support was given with the intent to further, facilitate, or carry out acts of terrorism.
The defendant's actions directly contributed to or enabled terrorism-related acts or the planning of such acts.
(c) Defenses
Defenses against a charge of providing material support for terrorism may include:
The defendant was unaware that the support provided would be used for terrorism, and therefore did not have the knowledge required for the offense.
The defendant did not intend for the support to aid terrorism and was misled regarding the purpose of the material support.
The defendant’s actions were taken under duress or coercion, or the evidence is insufficient to establish a direct link between the material support and terrorism-related acts.
(d) Aggravating Factors
The court may consider the following aggravating factors when determining the severity of the offense:
The defendant provided substantial support, such as large sums of money, weapons, or critical infrastructure, directly enabling the terrorist acts.
The defendant was a member of or had substantial ties to a terrorist organization and used their position to further the group’s terrorist agenda.
The defendant's actions were part of a coordinated effort, conspiracy, or long-term involvement in supporting terrorism.
The support provided was used in an act of mass violence or resulted in significant harm, loss of life, or destruction of property.
