(a) Definitions
The usage of radar/laser interfering devices refers to the act of using any device, system, or equipment that interferes with, jams, or disrupts the functioning of radar or laser speed detection devices used by law enforcement officers. These devices include, but are not limited to, radar jammers, laser jammers, and other technologies designed to obscure or hinder the ability of law enforcement to measure vehicle speed.
(b) Elements
To establish the offense of usage of radar/laser interfering devices, the prosecution must prove beyond a reasonable doubt the following elements:
The defendant was operating a motor vehicle.
The defendant possessed or used a device intended to interfere with radar or laser speed detection technology.
The device was in operation at the time the defendant was detected by law enforcement.
The defendant knowingly used or allowed the use of the device to avoid detection by law enforcement officers.
(c) Defenses
Defenses against a charge of using radar/laser interfering devices may include:
The defendant was not aware that the device was illegal or had been unknowingly given the device by another person.
The device was not in use at the time of the incident, or it malfunctioned and was not operating properly.
The defendant did not intend to interfere with law enforcement detection devices.
(d) Aggravating Factors
The court may consider the following aggravating factors when determining the severity of the offense:
