PREAMBLE
PREAMBLE WHEREAS, the Mayor of Los Santos recognizes the importance of preserving the peace, comfort, and well-being of its residents, businesses, and visitors; and
WHEREAS, excessive noise is a public nuisance that disrupts the quality of life, affects health and safety, and impedes the enjoyment of public and private spaces; and
WHEREAS, the Mayor of Los Santos is empowered to regulate and control noise levels within the city in order to protect residents from unreasonable disturbances while maintaining the freedoms of expression, commerce, and social interaction; and
WHEREAS, it is necessary to establish clear and enforceable standards for acceptable noise levels during different times of day to ensure that public spaces, neighborhoods, and businesses remain conducive to peaceful living and commerce; and
WHEREAS, the Mayor of Los Santos desires to balance the legitimate interests of all persons and entities, including residents, businesses, and visitors, in maintaining a vibrant urban environment that does not infringe upon the rights of others.
NOW, THEREFORE, BE IT ORDAINED by the Mayor of Los Santos as follows:
Section 1: Purpose and Intent
The purpose of this ordinance is to establish regulations to limit excessive noise within the City of Los Santos, particularly during night-time hours, and to curb disruptive activities that create unreasonable disturbances. This ordinance aims to:
Ensuring residents can enjoy peace, especially during sleeping hours.
Minimizing health impacts such as stress, hearing loss, and sleep disruption.
Protecting residential and commercial areas from noise pollution, including but not limited to loud music, vehicular disturbances, and industrial activities.
Preserving public health and welfare through consistent regulation and enforcement.
Section 2: General Noise Control
2.1 Prohibited Noise Levels
a. No person shall cause or permit noise that is unreasonable, excessive, or disruptive in public or private spaces.
b. Sound levels above 65 dBA in residential zones during nighttime hours or 75 dBA in commercial zones during daytime hours are considered excessive.
c. Officers may use calibrated sound meters to determine violations.
2.2 Unlawful Noise Between 11:00 PM and 10:00 AM
a. No person or entity shall produce loud music, amplified sound, or disturbing noises in public or private between 11:00 PM and 10:00 AM.
b. "Loud music" is defined as any audio that can be heard beyond 50 feet or outside the source premises or vehicle.
c. Permitted and city-approved events are exempt under specific conditions.
d. Routine sources like HVACs, generators, or alarms must not exceed 55 dBA in residential areas during night hours.
2.3 Street Racing and Vehicular Disturbances
a. Unauthorized street racing and high-speed exhibitions on public roads are strictly prohibited.
b. Car meets and legal automotive gatherings are allowed and encouraged under peaceful conditions. However, behaviors such as engine revving, burnouts, or sound system usage during quiet hours may result in citations if they cause noise exceeding 70 dBA.
c. Activities generating unnecessary vehicle noise between 10:00 PM and 8:00 AM may be enforced if complaints or disturbances occur.
d. Vehicles participating in unlawful activity may be towed at the owner’s expense.
2.4 Construction and Industrial Noise
a. Construction work, demolition, and landscaping shall occur only between 7:00 AM and 7:00 PM unless permitted for emergency or safety reasons.
b. Daytime noise shall not exceed 85 dBA at property boundaries.
Section 3: Noise Impact on Specific Areas
3.1 Residential Areas
a. Noise levels in residential zones shall not exceed 55 dBA between 10:00 PM and 8:00 AM.
b. Prohibited activities include loud music, parties, engine revving, and barking dogs when persistent and disturbing to nearby homes.
3.2 Commercial and Entertainment Districts
a. Entertainment venues may exceed general limits up to 85 dBA but only until 2:00 AM. After that, sound must be reduced to avoid disturbing nearby residences.
b. Amplified performances or outdoor events must end by 2:00 AM unless a permit specifies otherwise.
3.3 Industrial Zones
a. Industrial sites must adhere to a maximum noise level of 90 dBA during operating hours and 60 dBA during night hours unless performing essential overnight work.
Section 4: Enforcement and Penalties
4.1 Penalties for Violation
a. First offense: Fine of up to $1,000.
b. Second offense within 12 months: Fine of up to $2,000 or temporary business suspension up to 48 hours.
c. Third offense within 12 months: Fine up to $3,000, mandatory court appearance, and potential revocation of city permits.
d. Noise violations may result in immediate cessation orders issued by police or noise enforcement officers.
e. Repeat offenders may be placed under special monitoring or sound restrictions.
4.2 Citizen Complaints and Reporting
a. Residents may report violations via the Los Santos Police Department or the City Noise Control Hotline.
b. Reports will be investigated and violations addressed by citations or other legal means.
Section 5: Special Permits and Exceptions
5.1 Special Events
a. Temporary noise exemptions may be granted for parades, festivals, film shoots, or cultural events.
b. Permit applications must be filed with the Mayor’s Office.
c. Approved events must comply with assigned sound limits, time restrictions, and sound barrier requirements if applicable.
Event organizers are responsible for post-event clean-up and sound management.
5.2 Emergency Exemptions
a. Emergency vehicles and services are fully exempt from noise limits when responding to emergencies or public safety situations.
Section 6: Implementation and Public Awareness
a. The City shall conduct education campaigns, distribute flyers, and post signage in residential, entertainment, and industrial zones regarding noise expectations. b. City officials will host public hearings every 6 months to review and amend this ordinance as necessary. c. The ordinance shall be posted on the official City of Los Santos website and promoted through social media, radio, and television bulletins.
BE IT FURTHER RESOLVED, that this ordinance shall take effect on MAY 2ND, 2025 and remain in full force and effect until amended or repealed by the Mayor of Los Santos
